RESULTS OF THE MEETING OF MINERAL POWDER MANUFACTURERS ON THE ISSUE OF COUNTERING IMPORTS

The meeting of mineral powder manufacturers and Robinson Patman Law Firm took place on 28 July. We show gratitude to those who were able to join the discussion, and we hope that those who for some reason or another could not take part in the event will decide to join our initiatives after studying the materials.

The following results of the discussion can be noted:

  • Increased imports from Belarus already have a significant negative impact on the market, taking away the share of domestic manufacturers and dumping prices by low-quality products. In 2020, 163 thousand tons of such mineral powder were delivered, in the first half of 2021 – already 113 thousand tons (+ 144% compared to last year). For the country, among other things, this is the inadequate quality of road works. At the same time, the threat has a clear tendency to increase, and without intervention and counteraction is likely to reach critical scales for the industry.
  • In general, the meeting participants supported the proposal to conduct the anti-dumping investigation as a method of counteracting the import of mineral powder. The target of the barrier duty (the maximum realistic figure may be up to 40%) will be calculated in the further work of the process participants.
  • In addition to Belarus, it was decided to involve Russia in the anti-dumping investigation. Deliveries of mineral powder from Russia take place already, besides, at introduction of the duty for Belarus, the Belarusian mineral powder can be delivered through Russia.
  • To initiate and conduct the investigation, two things are definitely needed: uphold the appeal by more than 50% of market manufacturers and readiness to share the cost budget to implement the process. Based on the results of the discussion, Robinson Patman prepared a proposal for implementation of the anti-dumping investigation (the goal is to limit the import of Belarusian + Russian powder). The budget is distributed among all participants. The more companies join the initiative, the smaller share of the budget will fall on each of them.

The mineral powder manufacturers and interested market players are offered:

  • To read and get an understanding of the offer of Robinson Patman (available on request);
  • To determine readiness to support the appeal for the anti-dumping investigation (sign the relevant document);
  • To decide on the readiness to share the budget of costs for the implementation of the anti-dumping investigation process. After determining the companies that agree to finance the anti-dumping investigation process, a working group will be established with its own separate communication system. It is necessary to understand that these companies will represent the initiative part of the market, thus demonstrating their leadership positions and readiness to determine the ways of market development. In general, in addition to the anti-dumping investigation, the working group may initiate other areas aimed at developing the market of mineral powder, in particular, product quality control systems, intra-industry certification of manufacturers, etc.

We are waiting for the decision of the mineral powder manufacturers and interested market players to participate in the process until 30.07.2021.
